Article 2 - ORDER

The data recorded by SAOUDA at www.saouda.com constitute positive proof of all the commercial transactions between SAOUDA and its clients.

The automatic recording systems are considered relevant to establish the nature, content, and date of the order. SAOUDA confirms acceptance of the order placed by the client via e-mail using the e-mail address that the client has given. The sale is made only when the order is confirmed and when payment is validated by the relevant banking company.

SAOUDA reserves the right to cancel any order of a client with which there may be an issue over the payment of a previous order. The information produced by the clients upon passing their order is legally binding: should there be an error in the contact details of the consignee, SAOUDA refuses to accept responsibility for the impossible delivery of the product.

Any order means acceptance of the general terms of sale, price, and descriptions of the products available on sale.


Our product offers and prices are valid as long as they are visible on our website and while stocks last. For products not in stock at our warehouses, our offers are valid provided that raw material is available at our suppliers. In this matter, indications on products availability will be given to the client when placing his order. Since this information is directly provided by our suppliers, we do not exclude the possibilities of errors or changes. Should a product be unavailable when you place your order, you will be informed via email or by post asap.

Article 4 - DELIVERY

The delivery costs charged are calculated in proportion to the weight of the goods shipped. Part of the shipping costs is covered by SAOUDA.

The products purchased at the saouda.com shop are only delivered in the countries pre-selected from the "country" drop down list. The delivery times indicated are average times and correspond to the processing and delivery times for products shipped to metropolitan France and Monaco. Products are delivered at the address provided by the clients when placing their order. Any order not shipped within 30 days following its acceptance shall be cancelled, unless otherwise stated, and announced in the offer of sale. The products are delivered at the address indicated by the buyer on the order form and only in metropolitan France and Monaco. The client is responsible alone for the correctness of the contact details provided to SAOUDA when placing the order. For any order exceeding 50 € exclusive of VAT to be delivered in metropolitan France, SAOUDA will not charge any delivery fees.

SAOUDA delivers only in the following countries: France (including overseas departments and territories), Germany, Belgium, Netherlands, Luxembourg, Great Britain, Italy, Spain, Austria, Denmark, Ireland, Portugal, Finland, Norway, Sweden, Swiss, North Africa, Canada, US, Near and Middle East.

In case of absence of the consignee upon delivery (only in France), the goods are kept 15 days at the post office. After that period, the goods are sent back to SAOUDA. In this very case, a credit note in the amount of the order will be issued and valid for 2 months from its date of issuing.On the other hand, for orders from outside metropolitan France, please contact us.

SAOUDA refuses to accept responsibility for important delay in delivery due to postal services or carriers faults, in case of loss of goods, and strike.

All transport risks of the goods are borne by the consignee. Always check the goods upon delivery. You have a 48 hours period to express possible reservations to the carrier in case of missing pieces or damage.For orders from outside metropolitan France, please contact us.

Due to availability reasons, an order may be delivered in several shipments to the client.

Missing or damaged products

Even though SAOUDA takes great care over the preparation of the parcels, it is possible that a product may be missing or deteriorated after transport. Therefore, clients shall always make sure they check the condition of the products received. Any defect relating to delivery (missing or broken product, damaged parcel) shall be notified imperatively the next day following receipt at the latest via postal mail to the customer service of SAOUDA , 3 rue des Hauts de Chanturgue 63100 Clermont-Ferrand, France and via email at contact@saouda.com.

After this period, any claim will be rejected and SAOUDA will refuse to accept any responsibility.

SAOUDA will then ask the client to return the damaged parcel and will replace any damaged products or send again any missing pieces.

In the case of deliveries outside metropolitan France, the client shall undertake to cover any duties relating to the import of products, customs duties, VAT, and any other duties or taxes to be legally paid in the country of delivery. All orders placed with SAOUDA are for the private use of clients. Thus, SAOUDA refuses to accept any legal responsibility if the client has not paid due duties or taxes.

Possible delays will not give the client any right to claim damages.

In case of visible defects, the client can assert the product return right in accordance with the conditions set hereby.

Issues relating to delivery

 When the address specified by the buyer does not allow delivery of the ordered item and the product is returned to the seller, SAOUDA will cancel the order. Payment is cancelled by SAOUDA and the corresponding amount is credited back on the bank account of the buyer. Clients will receive an email inviting them to order again at saouda.com and to make sure beforehand their delivery details are correct.

Article 5 - PAYMENT

Payment of purchases is made with Visa or MasterCard payment solutions. The user alone is responsible for the payment via banker's card. SAOUDA is not responsible for payment issues related to the operation of the electronic payment service.

Parcels will be sent asap on weekdays after confirmation of payment by Visa or MasterCard system.

It is also possible to pay for the order with a cheque (French cheques only). Simply send your cheque payable to SAOUDA at the following address within 7 days:

Should payment be made with a cheque, the order will only be shipped after receipt of the payment cheque.

Article 6 - REFUND

The client has the right to a legal retraction period of seven (7) clear days from delivery of the product to return the product to SAOUDA and obtain a refund.For orders from outside metropolitan France, please contact us. The refund only applies to the ordered products and in no way to the shipment costs paid. To be able to assert its retraction right, the client shall send back the delivered product to the seller. The seller will then issue a refund. The refund will be given provided that the item is returned in its original packing, complete, intact, and clean. To insure that, the client shall check the solidity of the returned parcel making sure it will not be crushed during transport. The client shall enclose in the returned parcel copies of the invoice and of the delivery slip. The refunds of the products as described above will be achieved within a period not exceeding 15 days after receipt of the returned products. The refund will be carried out at saouda.com's discretion either by bank account credit or by cheque payable to the client who has placed the order and forwarded at the invoicing address.

Article 7- PRICES

Prices are in euros.

The price mentioned in the descriptions of the products does not include transport costs.

The price appearing on the order confirmation is the final price inclusive of all taxes and including VAT for France and countries of the EEC. This final price includes the price of the products and handling, packaging, and transport costs.

The products remain the property of SAOUDA until complete payment of the price.

Any change of the applicable rate shall be passed on to products prices. After this date, they are likely to be changed.

However, prices cannot be changed once the order has been placed. On the other hand, if several taxes or contributions, particularly environmental taxes, are created or changed upwards or downwards, they may be passed on to the sale price of the items available on the website and mentioned on sales documents.


These conditions are governed by the laws of France. SAOUDA cannot be held responsible for damage of any nature, whether material, immaterial, or physical resulting from an incorrect operation or an inappropriate use of the marketed products. This also applies to possible modifications of raw material products coming from suppliers. In any case, SAOUDA's responsibility will not exceed the value of the order and will not be implicated in case of minor errors or omissions despite all the precautions taken during the preparation of the products. 

In case of litigation, the relevant tribunal shall be that of the place of residence of the defendant or, at the defendant's discretion, that of the actual delivery location of the product.
